Terms of Service

These Terms of Service ("Terms") govern use of the 5 Star Reach service by business clients ("you"). By creating an account or using the service, you agree to these Terms.
The service
5 Star Reach sends review invitations by text message on your behalf from a local number registered to your business, hosts a review page presenting two options to every customer, delivers private feedback to you with same-day alerts, and emails you a monthly scorecard. Every customer receives the same invitation and sees the same options; the service does not screen or filter customers by sentiment.
Your responsibilities
- You will only submit contact information for customers with whom you have an existing business relationship and the necessary consent to send text messages, and you will comply with applicable law, including the TCPA and state telemarketing laws.
- You will honor customer opt-outs and will not ask us to re-message a customer who has replied STOP.
- You will comply with the policies of review platforms, including Google's review policies. Offering incentives for reviews, reviewing your own business, or soliciting reviews selectively can violate those policies.
- You are responsible for the accuracy of the business information you provide, including information used to register your texting number.
Billing
- Monthly plan: $99 per location per month, billed monthly in advance. Cancel anytime; cancellation takes effect at the end of the current billing period. No refunds for partial months.
- Annual plan: $990 per location per year, billed upfront. The annual plan is a prepaid commitment and is not refundable if canceled mid-term, though service continues through the end of the paid year.
- Group pricing: Multi-location group pricing is set out in your order confirmation.
- Review request texting is included; there are no per-message fees.
Healthcare clients
If you are a covered entity, a Business Associate Agreement between us must be in place before patient contact information is submitted to the service. Patient data is handled only in HIPAA-eligible infrastructure under a signed BAA.
Partner program
The referral partner program pays 30% of subscription fees for active, full-price referrals, subject to the program terms presented at partner signup, including attribution rules and payout schedules. We may modify or discontinue the program prospectively.
No outcome guarantees
Reviews are written by your customers, not by us. We do not guarantee any number of reviews, any rating, any ranking, or any revenue outcome. Review platforms control their own policies and may remove or decline to publish reviews at their discretion.
Acceptable use
You may not use the service to send unlawful, deceptive, or harassing messages, to message individuals without required consent, to solicit fake or incentivized reviews, or to interfere with the operation of the service. We may suspend or terminate accounts that violate these Terms or create legal risk.
Intellectual property
We retain all rights in the service, software, and templates. You retain all rights in your business information and customer data, and grant us a license to use it solely to provide the service.
Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability arising out of the service will not exceed the amounts you paid to us in the twelve months before the claim, and we will not be liable for indirect, incidental, or consequential damages.
Termination
You may cancel as described in Billing. We may terminate or suspend the service for breach of these Terms with notice where practicable. Sections that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Venue for disputes lies in the state or federal courts located in Colorado.
Changes
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance. The date at the top reflects the most recent revision.
